Dave asked: I’m a Senior and just bought a bicycle to ride. I see LOTS of information here about every other kind of bicycle-type vehicle, but I can’t easily find any information regarding whether or not you must have a license for an old-fashioned, peddle-type bicycle. What’s the Florida law regarding license and registration for those kinds of bikes?
Bicyclists are not required to have a drivers’ licenses since they are not operating motor vehicles.
s. 322.01 – Definitions. (For the purpose of driver’s licenses)
(27) “Motor vehicle” means any self-propelled vehicle …. excluding vehicles moved solely by human power ….
s. 322.03 – Drivers Must be Licensed; Penalties
(1) Except as otherwise authorized in this chapter, a person may not drive any motor vehicle upon a highway in this state unless such person has a valid driver’s license
Although a driver’s license or other identification is not required to operate a bicycle on the roadway or sidewalk, carrying identification is recommended since you may be required to identify yourself to law enforcement in case of a violation, collision or other incident.
For the same reason, bicycles are not required to be registered or have a title or license plate.
s. 320.01 – Definitions, General (For the purpose of registration)
(1) “Motor vehicle” means:
(a) …. the term does not include …. bicycles ….
s. 320.02 – Registration Required; Application for Registration; Forms
(1) Except as otherwise provided in this chapter, every owner or person in charge of a motor vehicle that is operated or driven on the roads of this state shall register the vehicle in this state.
Local authorities may enact ordinances requiring that the bicycle be registered, but that is different from the above. See this post.
The system of awarding points for driving infractions does not apply to bicycling violations since bicycles are not motor vehicles requiring a driver’s license.
