If the seat height is 25 inches or less it is not a bicycle.
I believe this was written to eliminate toy vehicles and was before recumbents became popular, since they typically have lower seats.
That does not affect the operator’s rights and duties though since the law applies to human powered vehicles. It does affect an electric assist bicycle.
