Placement of Feet on an eBike
Question
Brian asked: Do I have to use the pedals on my ebike in Fl? Do I have to keep my feet on the pedals while using the ebike motor? It is uncomfortable.
Answer
You did not describe your eBike, which can be controlled by different regulations, depending on its classification as a type of vehicle.
If your eBike meets the statutory definition of “bicycle”, its operation is controlled by the Bicycle Regulations.
s. 316.003 – Definitions
(2) Bicycle – Every vehicle propelled solely by human power, and every motorized bicycle propelled by a combination of human power and an electric helper motor capable of propelling the vehicle at a speed of not more than 20 miles per hour on level ground upon which any person may ride ….
There is no provision concerning placement of the feet while operating a bicycle, only that the cyclist must ride on or astride a permanent seat.
s. 316.2065 – Bicycle Regulations
(2) A person operating a bicycle may not ride other than upon or astride a permanent and regular seat attached thereto.
If your eBike is a motorcycle or moped, there are somewhat more definitive rules about the manner of riding the vehicle.
s. 316.2085 – Riding on Motorcycles or Mopeds
(2) A person shall ride upon a motorcycle or moped only while sitting astride the seat, with both wheels on the ground at all times, facing forward, and with one leg on each side of the motorcycle or moped.
