Child Support and eBikes

Question

Marco asked: What is the Florida state law on riding an ebike on a suspended license for non-payment of child support? I’ve never been in an accident, DUI or ever had an infraction where points were taken from my license. I’m 45 and have always been a safe driver.

Answer

Under some circumstances, a driver’s license can be suspended for non-payment of child support.  That is beyond the scope of this site.

s. 322.245 – Suspension of license upon failure of person charged with specified offense under chapter 316, chapter 320, or this chapter to comply with directives ordered by traffic court or upon failure to pay child support in non-IV-D cases as provided in chapter 61 or failure to pay any financial obligation in any other criminal case

A driver’s license is not required to ride a bicycle, the definition of which includes certain eBikes.

s.316.003 – Definitions

(3) Bicycle – Every vehicle propelled solely by human power, and every motorized bicycle propelled by a combination of human power and an electric helper motor capable of propelling the vehicle at a speed of not more than 20 miles per hour on level ground upon which any person may ride, having two tandem wheels, and including any device generally recognized as a bicycle though equipped with two front or two rear wheels. The term does not include such a vehicle with a seat height of no more than 25 inches from the ground when the seat is adjusted to its highest position or a scooter or similar device. A person under the age of 16 may not operate or ride upon a motorized bicycle.
