Citation for Careless Driving

Denise asked: My son was riding his bike on the proper part of the street. His back wheel was struck by a car and you can guess the obvious, he was knocked off the bike and fell on the car. He was given a ticket by a policeman for careless driving statute 316.1925. The officer was not present when the accident happened. How is it possible it’s his fault?

The statute you quote is this:

s. 316.1925Careless Driving

(1) Any person operating a vehicle upon the streets or highways within the state shall drive the same in a careful and prudent manner, having regard for the width, grade, curves, corners, traffic, and all other attendant circumstances, so as not to endanger the life, limb, or property of any person. Failure to drive in such manner shall constitute careless driving and a violation of this section.

There is no way for us to determine the circumstances of the incident or how the officer came to the conclusion that your son violated the statute. It may be that witnesses were interviewed. You may be able to obtain that from the police department. Retaining an attorney may facilitate that.
