@ Laura S.... ABSOLUTELY CORRECT! According to the Statutes, it says YOU NEED A DL.

@Kevin.....Ditto as @Laura S.... You need to get your harship THEN you can ride, but ONLY to work and back. (Been there, done that)

The law is clear....

Ya see, the point being, that the REASON they take your license away is as a PUNISHMENT. It wouldn't make sense, to take away your license, and then still let you drive a vehicle that requires said license.

The same thing happened in NJ (where I'm originally from)... Just like most states, you originally didn't need a license for a moped, so what would happen is, when someone lost their license for DnD, then they would just buy a Moped and drive, until EVERYONE was riding one, and STILL drinking and driving, and was creating more and more accidents and problems, hence they removed the moped from the non driving area to the needing of a license.

Okay, so let me see if I got this straight:
1. If you have a gas powered bicycle it is considered a moped, even if it has pedals that can be used.
2. If it is gas powered bicycle and considered a moped you have to have a DL.

Please tell me if I have this correct.

Thank you so much!

The site has been updated with new information about drivers' licenses for mopeds and motorized bicycles, and severe penalties for certain offenses.

Kevin,

At this site, we don't give legal advice. Rather, we are trying to provide a place for cyclists and law enforcement officials to learn more about the laws.

I recommend that you contact an attorney for that advice. Feel free to refer the attorney to this site for the information we have provided.

yes this info was very helpful but i am still in lew of the laws on mopeds i curently have a suspended habitual driving license but i am elagable to get a hard ship but the problem is i can get a hardship untill i have a job but at the moment i live a mim of 6 miles from the nearest bus line so i need a way to get to job interviews and thought i would get a moped because my understanding is that i dont have to have a license to drive a moped but my question is by me having habitual suspended license does that affect me being able to drive a moped? i just got out of jail because of my license and do not want to get in any more trouble because i will get at least a year if i do so your reply will reply would greatly appreciated. thanks kevin w arnold.
